This website (“Site”) is provided by Transmex Systems International Pte. Ltd (“we,” “our,” or “us”) to the person accessing the Site (“you,” or “your”). Your use and access to the Site, the products, services and associated software (collectively, the “Services”) shall be governed by these Terms of Service. If you accept or agree to these Terms of Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity. We reserve the right to change these Terms of Service from time to time and will post the most current version promptly on the Site.
1. You Agree to These Terms by Using the Site
Your access to, and use of, the Site is subject to the following Terms of Service and all applicable laws, rules and regulations. By accessing and using the Site and associated software, you accept, without limitation or qualification, these Terms of Service. We reserve the right, at our sole discretion, to modify, discontinue or terminate the Site or any Services provided through the Site, or to modify these Terms of Service, at any time and without prior notice. By continuing to access or use the Site or using any of the Services after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms of Service. If the modified Terms of Service are not acceptable to you, you should cease using the Site and any other Services.

(iv) engage in activity that is illegal, fraudulent, false, or misleading,
(v) transmit through the Services any material that may infringe the intellectual property or other rights of third parties;
(vi) build or benchmark a competitive product or service, or copy any features, functions or graphics of the Services;
(vii) upload or transmit any software, content or code that does or is intended to harm, disable, destroy or adversely affect performance of the Services in any way or which does or is intended to harm or extract information or data from other hardware, software or networks of ours or other users of Services;
(viii) engage in any activity or use the Services in any manner that could damage, disable, overburden, impair or otherwise interfere with or disrupt the Services, or any servers or networks connected to the Services or our security systems.
(ix) use the Services in violation of any of our policies or in a manner that violates applicable law, including but not limited to anti-spam, export control, privacy, and anti-terrorism laws and laws requiring the consent of subjects of audio and video recordings, and you agree that you are solely responsible for compliance with all such laws, rules and regulations.
Harassment in any manner or form on the Site, including via e-mail, chat, or by use of obscene or abusive language, or posting any obscene or abusive images or text, is strictly forbidden. Impersonation of others, including our employee, host, or representative, as well as other members or visitors on the site is prohibited.
4. Limitations on Use of Site
You may not reproduce, resell, or distribute the Services or any reports or data generated by the Services for any purpose unless you have been specifically permitted to do so under a separate agreement with us. You may not offer or enable any third parties to use the Services purchased by you (if applicable), display on any website or otherwise publish the Services or any content obtained from a Service (other than content created by you) or otherwise generate income from the Services or use the Services for the development, production or marketing of a service or product substantially similar to the Services.
5. User Submitted Content (where relevant)
You agree that you are solely responsible for the content sent or transmitted by you or displayed or uploaded by you in using the Services and for compliance with all laws pertaining to the content, including, but not limited to, laws requiring you to obtain the consent of a third party to use the content and to provide appropriate notices of third party rights. You represent and warrant that you have the right to upload the content to the Site (where applicable) and that such use does not violate or infringe on any rights of any third party. Under no circumstances will we be liable in any way for any
(a) content that is transmitted or viewed while using the Services,
(b) errors or omissions in the content, or
(c) any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to content.
Where relevant, you retain copyright and any other rights you already hold in content which you submit, post or display on or through, the Services.
We reserve the right, in our sole discretion, to block or remove user accounts or delete content that is unacceptable. We may, at any time, delete any content without notice to you if we become aware that there is violation of any provision of these Terms of Service, or any law. Unacceptable content includes, but is not limited to:
(i) pornographic content;
(ii) Chatroulette-style experiences;
(iii) objectification of real people (e.g. “hot-or-not” voting);
(iv) making physical threats, slander or bullying;
(v) impersonation, fraud and phishing;
(vi) invasion of privacy;
(vii) content that supports criminal acts;
(viii) content that infringes on intellectual property rights of third parties;
(ix) discrimination, racism and contempt of religion;
(x) gambling; and
(xi) terrorism.
6. General Conditions
In addition to any other conditions included in these Terms which you must comply with, please also be aware of the following:
- Age: Your eligible age is subject to the laws of the country you are from. You may also be required to seek the consent of your parent or guardian to download, register or otherwise use the Services.
- Operating System: The Site requires your device to be operating with at least version iOS 10 (for Apple devices), Android 6 (for Android devices), Windows 10, and/or MacOS 10.13.0.
- Device Fees: You are wholly responsible for all carrier data plan and other applicable fees and taxes associated with your use of the services.
- Account Security: You are responsible for keeping your device, your account and any security codes/passwords (if requested) safe and secure.
7. Electronic Communications and Notice
You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
8. Device Data, Functions and Access
To operate the Site efficiently and to the best of its potential ability and functionality, we may require access to the following data and functions on your device:

- phone book and contacts;
- photos, images and videos;
- camera;
- documents;
- location data;
- microphone;
- calendar;
- storage; and

Our Privacy Policy is incorporated and made part of these Terms of Service. You hereby acknowledge and agree to such Privacy Policy. Any other communication or material you transmit to the Site will be treated as non-confidential and non-proprietary.
10. Disclaimer – Warranty
THE SITE, ITS CONTENT, MATERIALS, SERVICES AND PRODUCTS ON THE SITE ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
We do not represent or warrant that the functions contained in the Site will be uninterrupted or error-free, that the defects will be corrected, or that the Site or the server that makes the Site available are free of viruses or other harmful components.
